XTUDENT – TRAINER / INSTRUCTOR POLICY

1. INTRODUCTION
This Trainer / Instructor Policy (“Policy”) governs the participation of trainers, educators, mentors, industry professionals, and content creators (“Trainers”, “Instructors”) who publish, sell, or distribute educational content on xtudent.in (“Xtudent”, “Platform”, “We”, “Us”, “Our”).
This Policy forms an integral part of the Terms & Conditions available on xtudent.in. By registering as a Trainer, you agree to be bound by this Policy and all other applicable Platform policies.
2. ROLE OF XTUDENT
Xtudent operates strictly as:
- A technology platform, and
- A marketplace facilitator
Xtudent:
- Does not employ Trainers
- Does not act as an agent, partner, or representative of Trainers
- Does not guarantee sales, revenue, audience reach, or outcomes
Trainers operate independently and are solely responsible for their content, conduct, and compliance.
3. TRAINER ELIGIBILITY
To become a Trainer on xtudent.in, you must:
- Be at least 18 years of age
- Be legally competent to enter into binding agreements
- Provide accurate identity, contact, and payout information
- Possess rights and authority over the content you submit
Xtudent reserves the right to approve, reject, or revoke Trainer access at its sole discretion.
4. TRAINER ACCOUNT & RESPONSIBILITIES
Trainers are responsible for:
- Maintaining accurate profile information
- Securing account credentials
- Ensuring compliance with Platform policies
- Timely response to learner queries (where applicable)
Trainers shall not:
- Share or transfer accounts
- Misrepresent qualifications or affiliations
- Engage in misleading marketing or claims
5. CONTENT OWNERSHIP & LICENSE
5.1 Ownership
Trainers retain ownership of their original course content uploaded to xtudent.in, subject to applicable laws.
5.2 License to Xtudent
By uploading content, Trainers grant Xtudent a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to:
- Host, store, stream, and distribute content
- Display, promote, and market courses
- Use excerpts for Platform promotion
This license remains valid for as long as the content is available on xtudent.in.
6. CONTENT STANDARDS & PROHIBITIONS
Trainer content must:
- Be original or properly licensed
- Be educational in nature
- Comply with applicable laws and regulations
- Avoid plagiarism, piracy, or infringement
Prohibited content includes:
- Illegal, abusive, or hateful material
- Copyright-infringing content
- Misleading, deceptive, or fraudulent claims
- Explicit, obscene, or unethical material
Xtudent reserves full rights to review, remove, or restrict content.
7. CONTENT REVIEW & MODERATION
Xtudent may:
- Review content before or after publication
- Request revisions or updates
- Temporarily or permanently remove content
- Suspend or terminate Trainer accounts for violations
Xtudent is not obligated to provide reasons for content rejection or removal.
8. PRICING & REVENUE SHARING
- Course pricing is determined by Trainers, subject to Platform guidelines
- Xtudent may suggest pricing based on market dynamics
- Revenue share percentages and payout cycles are governed by separate commercial terms communicated to Trainers
Xtudent reserves the right to revise revenue structures with prior notice.
9. PAYOUTS & TAX RESPONSIBILITY
- Trainer payouts are processed through approved payment methods
- Trainers are solely responsible for:
- Declaring income
- Paying applicable taxes
- Regulatory compliance in their jurisdiction
Xtudent shall not be liable for Trainer tax obligations or reporting errors.
10. REFUNDS & DISPUTES
- Refunds are governed by the Refund & Cancellation Policy available on xtudent.in
- Trainers must comply with Platform refund decisions
- Xtudent retains final authority in dispute resolution between Trainers and Users
11. PROMOTION & COMMUNICATION
Trainers may:
- Promote their courses externally, provided claims are truthful
- Use Xtudent branding only as permitted
Trainers may not:
- Solicit users outside the Platform to bypass Xtudent
- Collect learner data outside Platform systems
- Engage in spam or unauthorized promotions
12. CONFIDENTIALITY
Trainers shall not disclose:
- Platform analytics or internal data
- User information
- Commercial or operational details of Xtudent
Confidentiality obligations survive account termination.
13. ACCOUNT SUSPENSION & TERMINATION
Xtudent may suspend or terminate Trainer accounts:
- For policy violations
- For content misuse or piracy
- For fraudulent or unethical behavior
- At its sole discretion, with or without notice
Upon termination:
- Content access may be removed
- Outstanding payouts may be withheld pending investigation
- Licenses granted to Xtudent survive as necessary for legal and operational purposes
14. LIMITATION OF LIABILITY
Xtudent shall not be liable for:
- Trainer revenue loss
- Course performance or sales
- Learner satisfaction or outcomes
- Platform interruptions or third-party failures
15. INDEMNIFICATION
Trainers agree to indemnify Xtudent against any claims arising from:
- Content infringement
- Misrepresentation
- Policy violations
- Legal non-compliance
16. POLICY MODIFICATIONS
Xtudent reserves the right to modify this Policy at any time.
Changes take effect immediately upon publication on xtudent.in. Continued participation constitutes acceptance.
