1. INTRODUCTION
This Intellectual Property & Anti-Piracy Policy (“Policy”) governs the ownership, protection, use, and enforcement of intellectual property rights on xtudent.in (“Xtudent”, “Platform”, “We”, “Us”, “Our”).
This Policy applies to all users, members, trainers, instructors, and visitors accessing or using xtudent.in and forms an integral part of the Terms & Conditions available on xtudent.in.
2. XTUDENT PLATFORM INTELLECTUAL PROPERTY
All intellectual property associated with xtudent.in, including but not limited to:
- Website architecture and layout
- User interface and experience design
- Platform software and source code
- Branding, logos, trademarks, and domain name
- Proprietary workflows, systems, and documentation
are the exclusive property of Xtudent and are protected under applicable intellectual property laws.
Unauthorized use, reproduction, modification, or distribution is strictly prohibited.
3. TRAINER CONTENT OWNERSHIP
- Trainers retain ownership of their original content uploaded to xtudent.in
- Trainers confirm that they possess all necessary rights, licenses, and permissions to publish such content
- Trainers are solely responsible for ensuring content does not infringe third-party rights
Xtudent does not claim ownership over Trainer-created educational content.
4. LICENSE GRANTED TO XTUDENT
By uploading or publishing content on xtudent.in, Trainers grant Xtudent a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to:
- Host, store, stream, and distribute content
- Display and make content available to users
- Promote, market, and advertise content on and off the Platform
- Use content excerpts, thumbnails, and previews for promotional purposes
This license remains effective for the duration the content is hosted on xtudent.in, and where required for legal, archival, or dispute resolution purposes.
5. USER CONTENT & LIMITED LICENSE
Any content submitted by Users (including comments, reviews, or community posts):
- Remains the property of the User
- Grants Xtudent a limited license to display, moderate, and use such content for Platform operations
Xtudent may remove user content at its discretion.
6. PROHIBITED USE OF CONTENT
Users and Trainers are strictly prohibited from:
- Screen recording, screen capturing, or copying course content
- Downloading or storing content without permission
- Redistributing, reselling, or sharing content outside xtudent.in
- Uploading Xtudent content to third-party platforms
- Sharing login credentials or access links
- Using automated tools, bots, or scrapers to access content
Any such actions constitute content piracy and intellectual property infringement.
7. ANTI-PIRACY ENFORCEMENT
Xtudent employs a combination of:
- Technical safeguards
- Usage monitoring
- Manual and automated detection mechanisms
Xtudent reserves the right to:
- Suspend or terminate accounts involved in piracy
- Revoke access without refund
- Disable content access immediately
- Initiate civil or criminal proceedings
- Cooperate with law enforcement and regulatory authorities
8. COPYRIGHT INFRINGEMENT COMPLAINTS
If you believe your copyrighted work has been infringed on xtudent.in, you may submit a written complaint including:
- Identification of the copyrighted work
- Description of the alleged infringement
- Proof of ownership or authorization
- Contact details of the complainant
Complaints may be sent to xtudent.in@gmail.com.
Xtudent may remove or disable access to allegedly infringing content while reviewing the complaint.
9. FALSE OR MALICIOUS CLAIMS
Submitting false, misleading, or malicious infringement claims may result in:
- Account suspension or termination
- Legal liability for damages
- Denial of future claims
Xtudent reserves the right to act against abuse of the complaint mechanism.
10. REPEAT INFRINGER POLICY
Xtudent enforces a zero-tolerance policy for repeat infringers.
Users or Trainers found repeatedly violating intellectual property rights may have their accounts permanently terminated without notice.
11. CONFIDENTIALITY & PLATFORM DATA
Unauthorized access to:
- Platform analytics
- Course performance data
- Internal dashboards
- User information
is prohibited and may attract legal consequences.
12. LIMITATION OF LIABILITY
Xtudent shall not be liable for:
- Unauthorized third-party piracy beyond reasonable control
- Trainer content infringements committed without Xtudent’s knowledge
- Losses arising from enforcement actions
13. INDEMNIFICATION
Users and Trainers agree to indemnify Xtudent against claims, losses, or damages arising from:
- Intellectual property violations
- Unauthorized content use
- Misrepresentation of ownership
14. POLICY UPDATES
Xtudent reserves the right to update this Policy at any time.
Changes will be effective immediately upon posting on xtudent.in. Continued use of the Platform constitutes acceptance of the revised Policy.
